Content Ownership and AI Usage Policy

The Lenera AI platform enables customers to create AI-generated training videos by combining customer-supplied materials with Lenera AI's proprietary platform technology and third-party AI systems. This policy explains, with precision, who owns what in that process — from the underlying AI infrastructure to the final video output your organisation receives.
2. The Three-Layer Ownership Model
Lenera AI's platform integrates multiple layers of technology, each with distinct ownership. Understanding this layered structure is essential for Customers evaluating intellectual property rights in their AI-generated content.

2.1 Layer 1: Provider-Owned Avatar and AI Assets
The base AI models, avatar libraries, and rendering technologies powering Lenera AI's video generation capabilities are owned by and licenced from third-party AI providers, principally D-ID Ltd. ("D-ID"). These assets include:
- The avatar library — the collection of pre-built AI-rendered human avatars available within the platform;
- Avatar likenesses — the trained representations, facial geometry models, and visual characteristics of each avatar;
- Animation models — the machine learning models that animate avatar lip movement, expressions, and gestures based on input text or audio;
- Rendering technology — the inference infrastructure, GPU pipelines, and post-processing systems that produce the final video frames; and
- Associated intellectual property — patents, trade secrets, and copyrights in the underlying model architecture.
Customers do not acquire any ownership interest in Layer 1 assets by using the Service. Use of these assets is subject to D-ID's terms of service in addition to Lenera AI's terms. Lenera AI's licence from D-ID permits use of these assets for the Service as described herein; it does not transfer to Customers.
2.2 Layer 2: Lenera AI Platform and Workflow
Lenera AI owns all intellectual property in its platform, workflow, and creative tooling. This includes:
- Templates — the pre-designed video layout structures, scene configurations, and presentation formats available within the platform;
- Storyboard system — the logic, data models, and tooling that enable customers to structure multi-scene video narratives;
- Remotion compositions — the custom Remotion Lambda-based rendering compositions that define how content elements are assembled into video;
- Branding system — the tools and data models that enable customers to apply their organisational branding (logos, colours, fonts) to generated videos;
- Workflow logic — the orchestration code, APIs, and processing pipelines that coordinate content ingestion, AI rendering, and output delivery;
- Orchestration and prompt systems — the proprietary prompt engineering, AI orchestration architecture, and system designs that direct AI model behaviour; and
- Platform software — all application code, databases, APIs, interfaces, and documentation created by or for Lenera AI.
Lenera AI retains all right, title, and interest in Layer 2 assets. No licence to Layer 2 assets is granted to Customers beyond the limited right to use the Service as set out in the Terms of Service and MSA.
2.3 Layer 3: Customer Output
The final AI-generated video — the output your organisation receives after processing your content through the Lenera AI platform — belongs to you. This is the core of our customer-first IP commitment.
Layer 3 consists of everything the Customer contributes and everything the Customer ultimately receives. This includes:
- Uploaded materials — scripts, text prompts, slide decks, images, logos, source videos, and any other content you supply to the platform;
- Custom branding — your organisation's brand identity elements (logo, colour scheme, typography) as applied to generated content;
- Generated training video — the final AI-rendered video output produced by the platform using your materials and the Lenera AI workflow; and
- Customised AI-rendered content — narrated avatars, branded scenes, and assembled video sequences that incorporate your specific instructions and content.
Customer ownership of Layer 3 output is subject to the following conditions:
- Payment: All fees due under the applicable Order Form or subscription must be current;
- Compliance: The output must be generated in compliance with this Policy, the AUP, and the ToS/MSA;
- Lenera AI Licence: Layer 3 output incorporates Layer 1 and Layer 2 elements under licence. Customer's ownership of the output is conditioned on continued compliance with Lenera AI's terms and the underlying D-ID licence;
- D-ID Terms: Use of the generated output is also subject to D-ID's Terms of Service, which govern use of the avatar assets embedded in the output; and
- Third-party rights: The output may incorporate your uploaded materials that are subject to third-party intellectual property rights. Customer is responsible for ensuring all uploaded materials are used with appropriate authorisation.
3. Customer Content Ownership in Detail
3.1 Uploaded Content
You retain full ownership of all content you upload to the Service ("Customer Content"). Lenera AI does not acquire any ownership interest in Customer Content by virtue of you uploading it. You grant Lenera AI a limited, non-exclusive, royalty-free licence solely to process, store, and transmit Customer Content as necessary to provide the Service to you.
This licence:
- Is limited to the purpose of delivering the Service to you;
- Does not permit Lenera AI to use Customer Content for any other purpose, including marketing, model training, or benchmarking; and
- Terminates when your account is deleted and your data is purged in accordance with the Privacy Policy and DPA.
3.2 AI Output Ownership
Subject to full payment and compliance with the applicable terms, you own the AI-generated video output produced by the Service using your Customer Content ("AI Output"). You may:
- Use AI Output for your internal training, onboarding, communications, and educational purposes;
- Distribute AI Output to your employees, students, clients, or other authorised recipients;
- Edit, modify, or adapt AI Output for your own purposes; and
- Reproduce and display AI Output in the normal course of your business.
You may not:
- Claim that AI Output was produced without AI assistance when presenting it as human-created work;
- Use AI Output to train competing AI models;
- Sublicence or commercialise AI Output in a manner that constitutes a resale of Lenera AI's Service; or
- Use AI Output in a manner that violates D-ID's terms regarding use of avatar-rendered content.
4. Lenera AI Platform Intellectual Property
Lenera AI and its licensors retain all right, title, and interest in:
- All software, code, databases, and systems comprising the Lenera AI platform;
- All templates, workflows, Remotion compositions, and proprietary tooling;
- All AI model architectures, prompt engineering, and orchestration systems developed by Lenera AI;
- All trademarks, service marks, trade names, and brand elements of Lenera AI;
- All documentation, guides, and training materials created by Lenera AI; and
- All anonymised, aggregated usage data and platform performance metrics.
Except for the limited licences expressly granted in the ToS and MSA, no intellectual property rights in Lenera AI's platform are transferred to Customers.
5. Third-Party Technology Rights
5.1 D-ID Avatar Technology
The avatar rendering capabilities of the Service are powered by D-ID Ltd. The following rules apply to D-ID avatar assets as embedded in AI Output:
- D-ID retains ownership of the underlying avatar library, likenesses, animation models, and rendering technology;
- Lenera AI licences these assets from D-ID for use in Service delivery under D-ID's commercial terms;
- Customer's right to use AI Output that incorporates D-ID avatar content is conditioned on compliance with both Lenera AI's terms and D-ID's Terms of Service;
- D-ID's Terms of Service prohibit use of its avatar technology to create content that defames, harasses, or endangers real individuals, or that violates applicable law; and
- Lenera AI does not warrant that D-ID's licence terms will remain unchanged. Material changes to D-ID's terms will be communicated to Customers with reasonable advance notice.
5.2 Other AI Providers
The Service also incorporates AI components from Google (TTS), and DeepSeek for script generation and voice synthesis. These providers:
- Do not claim ownership of output generated using their models (subject to their respective terms);
- May impose restrictions on certain categories of use case — see their respective usage policies; and
- Are subject to change — Lenera AI will notify Customers of material changes to integrated AI providers as part of the sub-processor notification process.
6. AI Training Restrictions
The following AI training restrictions apply to protect Customer data, third-party IP rights, and the integrity of the platform:
6.1 Lenera AI Will Not
- Use Customer Content (uploaded scripts, branding, materials) to train general-purpose AI models without prior written consent from the Customer;
- Share Customer Content with other customers or third parties except as set out in the Sub-processor List;
- Use Customer-generated AI Output as training data for competing models; or
- Use biometric data derived from Customer uploads for any purpose other than rendering the requested output.
Lenera AI may use anonymised, aggregated platform usage data (e.g., performance metrics, feature usage statistics) to improve the Service. This data does not contain Customer Content or personally identifiable information.
6.2 Customer Must Not
- Use AI Output to train, fine-tune, or improve any AI model — including internally developed models — without Lenera AI's prior written consent;
- Attempt to extract, reconstruct, or replicate Lenera AI's proprietary prompt architecture, orchestration systems, or model configurations by systematic querying or reverse engineering;
- Use the Service's API or platform access to build a competing AI video platform or similar product; or
- Harvest or scrape the Service's output at scale for dataset construction purposes.
7. Biometric Data and Likeness Rights
Where the Service renders AI-generated video using voice synthesis or avatar animation, the following principles apply:
7.1 Default Avatar Library
The avatars available in the standard Lenera AI avatar library are AI-generated digital personas licensed from D-ID. They do not represent real, identifiable individuals. No biometric data of real persons is captured in connection with default avatar usage.
7.2 Custom Avatars and Voice Cloning
Where a Customer uses a custom avatar or voice cloning feature (where available on applicable subscription tiers):
- The Customer must obtain all legally required written consents from the individual whose voice or likeness is being used;
- Consents must specifically authorise the creation of AI-generated video using the individual's likeness or voice for the described purpose;
- The Customer is solely responsible for compliance with all applicable biometric data laws, including BIPA (Illinois 740 ILCS 14), CUBI (Texas Bus. & Com. Code §503.001), CWCBA (Washington RCW 19.375), and equivalent laws;
- Lenera AI processes voice and visual input only to the extent necessary to render the requested output and does not retain biometric templates beyond the processing session unless the Customer explicitly saves a custom avatar; and
- Custom avatar data saved to a Customer's account is treated as Customer Content under the DPA.
7.3 Minor Biometric Data
Uploading biometric data of persons under the age of 18 (minors) is strictly prohibited without verified parental or guardian consent. Education customers using the platform in contexts where minor students may appear in uploaded content must obtain appropriate consents in accordance with COPPA, FERPA (where applicable), and any relevant state minor privacy laws before uploading such content.
8. Feedback
If you provide Lenera AI with feedback, suggestions, or ideas about the Service ("Feedback"), you grant Lenera AI a perpetual, irrevocable, worldwide, royalty-free licence to use, copy, modify, create derivative works from, and otherwise exploit that Feedback for any purpose, without compensation to you. Feedback does not include Customer Content. You retain all ownership of Customer Content regardless of whether you provide Feedback.
9. Copyright, DMCA, and Content Removal
9.1 Copyright Compliance
Customers are responsible for ensuring that all content uploaded to the Service and all AI Output they produce does not infringe the copyright of any third party. This includes:
- Obtaining appropriate licences for any copyrighted material (images, music, video clips, fonts, logos) incorporated into Customer Content;
- Not uploading or using copyrighted works owned by third parties without authorisation; and
- Ensuring that AI Output does not reproduce copyrighted text, music, or imagery without appropriate licencing.
9.2 DMCA Takedown Procedure
To submit a DMCA takedown notice, please send a written notification to our designated agent containing the information required under 17 U.S.C. §512(c)(3) to:

Counter-notifications may be submitted to the same address in accordance with 17 U.S.C. §512(g)(3). Repeat infringers may have their accounts terminated.
10. AI Output Disclaimer
AI Output generated by the Service:
- Is produced by machine learning systems that may generate inaccurate, incomplete, or contextually inappropriate content;
- May contain factual errors, biases, or omissions — particularly when dealing with complex, specialised, or rapidly evolving subject matter;
- Does not constitute professional advice of any kind (legal, medical, financial, educational, or otherwise);
- Should be reviewed by qualified humans before being used in contexts where errors could cause harm; and
- Is not certified as accessible, ADA-compliant, or suitable for regulated industries without appropriate review and configuration.
The Customer is responsible for reviewing AI Output before use and for ensuring it meets the Customer's internal quality, accuracy, and compliance standards. Lenera AI's liability for AI Output content is limited as set out in the MSA.
11. Special Considerations for Educational Use
Customers using AI Output in educational or training contexts should be aware of the following:
- Disclosure obligation: Many jurisdictions and institutional policies require disclosure to learners that educational materials have been AI-generated. Customers are responsible for making any required disclosures.
- Accuracy verification: AI-generated educational content should be reviewed and verified by subject-matter experts before deployment in instruction.
- Student data: Do not incorporate personally identifiable student information into AI prompts or uploaded materials without appropriate consents and legal authorisation. See the Acceptable Use Policy for student data restrictions.
- Assessment: AI Output should not be used as the sole basis for consequential assessments or decisions about individual learners without human review.
- Bias: AI systems may reflect biases present in training data. Review AI Output for potential bias before use in instruction, particularly for diverse learner populations.
12. Content Moderation and Removal
While Lenera AI does not pre-screen Customer Content or AI Output, we reserve the right to review, suspend access to, or remove content that:
- Violates the Acceptable Use Policy or these terms;
- Is reported by third parties as infringing or illegal;
- Is flagged by automated content safety systems; or
- Is required to be removed by law, court order, or regulatory direction.
We will provide prompt notice to account administrators where practicable before removing content, except where notice would impede a law enforcement investigation or where the content constitutes CSAM or involves imminent safety risks.
13. Changes to This Policy
Lenera AI may update this Policy to reflect changes in our technology, legal environment, or business practices. For material changes affecting Customer IP rights or AI training practices, we will provide at least sixty (60) days' prior written notice. Continued use of the Service after the effective date constitutes acceptance. Customers who do not accept material changes may terminate their subscription in accordance with the applicable MSA.
