Acceptable Use Policy
1. Purpose and Scope
This Acceptable Use Policy ("AUP") describes the rules governing use of the Lenera AI platform, website, APIs, and related services (collectively, the "Service"). This AUP is incorporated by reference into our Terms of Service ("ToS") and Master Services Agreement ("MSA") and has the same legal force as those agreements.
This AUP applies to every person or entity that accesses or uses the Service in any capacity, including:
- Customer organisations and their designated administrators;
- Individual authorised users (employees, contractors, or students granted access by a Customer);
- API developers building integrations; and
- Visitors to the Lenera AI website.
2. Permitted Uses
Subject to your subscription tier and compliance with this AUP, you may use the Service to:
- Create AI-generated training videos, onboarding materials, and internal communications for legitimate corporate or educational purposes;
- Generate synthetic-voice narration and avatar-led video using licensed avatar assets provided within the platform;
- Upload, store, and process your organisation's content (scripts, branding, images, presentation materials) to produce AI-assisted video output;
- Access and use the platform's APIs to build internal integrations or workflows, subject to the API terms in the ToS;
- Share generated video content with your employees, students, clients, or authorised third parties for the purposes set out in your Order Form; and
- Reproduce, distribute, and display AI Output you own, subject to applicable licences and the Content Ownership and AI Usage Policy.
3. General Prohibitions
You may not use the Service to:
3.1 Illegal and Harmful Content
- Create, upload, transmit, or distribute any content that is unlawful, defamatory, obscene, fraudulent, or that violates any applicable law or regulation;
- Harass, threaten, or intimidate any person;
- Infringe the intellectual property, privacy, publicity, or other rights of any third party; or
- Promote hate speech, discrimination, or violence against any individual or group.
3.2 Deceptive and Misleading Conduct
- Create content intended to deceive, defraud, or mislead any person or organisation;
- Produce synthetic media falsely attributing statements, actions, or positions to real individuals without their explicit written consent;
- Impersonate any person, company, or governmental body; or
- Distribute AI-generated content as if it were authentic unaltered footage without appropriate disclosure.
3.3 System Integrity
- Attempt to probe, scan, or test the vulnerability of the Service or any associated network or system;
- Circumvent, disable, or otherwise interfere with security features, authentication mechanisms, or access controls;
- Introduce malware, viruses, trojan horses, or any other harmful code;
- Conduct denial-of-service attacks or disrupt the Service for other users; or
- Scrape, crawl, or use automated means to extract data from the Service beyond normal API usage within your authorised rate limits.
3.4 Unauthorised Commercial Exploitation
- Resell, sublicense, or commercialise access to the Service without prior written approval from Lenera AI;
- Build a competing product or service using the Service, its output, or its underlying technology;
- Use the Service's API to provide a service that substantially replicates the core functionality of the Service to third parties; or
- Permit access to the Service by persons or entities not authorised under your subscription.
4. AI-Specific Prohibitions
4.1 Deepfakes and Non-Consensual Synthetic Media
You must not use the Service to create any synthetic media (video, audio, or image) that:
- Depicts a real, identifiable person without their prior, explicit, and documented written consent;
- Is designed to deceive a viewer into believing they are watching authentic footage of a real person;
- Would constitute a "deepfake" under any applicable law, including state synthetic-media disclosure statutes (e.g., California AB 602, Texas HB 4337, Virginia Code §18.2-386.2); or
- Is used for political advertising, electoral interference, or to influence an election without mandatory disclosure.
4.2 Biometric Data
The Service may process voice biometrics and facial geometry to render avatar animations. Accordingly:
- If you upload video, audio, or images of real individuals, you represent and warrant that you have obtained all legally required written consents for biometric data collection, processing, and use under applicable law, including BIPA (Illinois), CUBI (Texas), and CWCBA (Washington);
- You must maintain a written biometric data retention and destruction schedule;
- You must not upload biometric data of minors (persons under 18) without verified parental or guardian consent; and
- Customer-uploaded biometric data is processed only as directed by you and is not used to train general-purpose AI models.
4.3 Model Training and Reverse Engineering
- You may not use AI Output generated by the Service to train, fine-tune, or improve any AI model — including your own — without Lenera AI's prior written approval;
- You may not reverse engineer, decompile, or attempt to extract model weights, architecture, or training data from the Service; and
- You may not attempt to reconstruct or replicate Lenera AI's proprietary AI systems, prompt structures, orchestration logic, or template systems through systematic querying or other means.
4.4 Regulated Industries
The Service is not certified for use in the following contexts without a separately negotiated addendum:
- Medical or clinical training where inaccurate AI output could cause patient harm (HIPAA BAA required);
- Financial advice or securities education where regulatory requirements apply (FINRA, SEC); and
- Legal services or law enforcement training where privileged or sensitive information is involved.
5. Educational Use Standards
Customers using the Service for corporate education, professional training, or academic instruction agree to the following additional standards:
5.1 Student and Learner Data
- Do not upload personally identifiable student education records as defined under FERPA without a signed Educational Data Addendum;
- Do not use the Service in a manner that would constitute a violation of FERPA, COPPA, or applicable state student privacy laws (including SOPIPA, MIPA, and equivalent statutes);
- Obtain appropriate institutional or parental consent before using the platform in any K–12 context where minor learners will be identifiable in generated content; and
- Ensure all generated training content complies with your institution's academic integrity and responsible-AI-use policies.
5.2 Accuracy and Disclosure
- AI-generated educational content may contain errors, omissions, or biases. Do not present AI-generated content as expert-reviewed or authoritative without independent verification;
- Disclose to learners when educational materials have been created using AI-generated video or synthetic narration; and
- Do not use AI-generated assessments, evaluations, or learning records as the sole basis for consequential decisions about individuals without human review.
6. Content Standards
6.1 Uploaded Content
All content you upload to the Service ("Customer Content") must:
- Be owned by you or licenced to you with sufficient rights to permit processing by the Service;
- Not infringe any copyright, trademark, patent, trade secret, or other intellectual property right;
- Not contain personally identifiable information of third parties without their consent; and
- Not violate any applicable export control, sanctions, or other laws.
6.2 Prohibited Content Categories
You must not upload, generate, or distribute content that:
- Constitutes child sexual abuse material (CSAM) or sexually exploits minors in any way;
- Depicts graphic violence, gore, or torture;
- Contains threatening, abusive, or hateful language directed at individuals or protected groups;
- Promotes illegal activities, terrorism, or extremist ideologies;
- Contains unsolicited commercial solicitation or spam; or
- Violates any third-party terms of service or platform policies (including those of D-ID, Anthropic, Google, or other integrated providers).
6.3 Content Moderation
Lenera AI does not pre-screen Customer Content but reserves the right to review, suspend, or remove content that violates this AUP. We may use automated tools and human reviewers for this purpose. Content flagged for review will be notified to the account administrator where practicable.
7. Consent and Likeness Rights
Where you use the Service to render custom avatars based on real individuals, or to synthesise voices or likenesses:
- You must obtain documented written consent from each individual prior to processing their likeness or voice;
- Consent must specifically authorise the creation of AI-generated video using the individual's likeness or voice for the intended purpose;
- You must retain consent records for a minimum of five (5) years and provide them to Lenera AI upon request; and
- You are solely responsible for ensuring that your use of any third party's likeness complies with applicable right-of-publicity, defamation, and privacy laws in all relevant jurisdictions.
By using the Service, you represent and warrant that all legally required consents have been obtained. Lenera AI makes no representation that use of the default avatar library involves real individual likenesses. See the Content Ownership and AI Usage Policy for details on the three-layer IP ownership model.
8. API Use Standards
- API use is subject to the rate limits and technical specifications set out in the API documentation;
- API keys are credentials and must be kept confidential. You are responsible for all activity under your API key;
- You must not attempt to circumvent rate limits through multiple accounts or credential sharing;
- Lenera AI may throttle, suspend, or revoke API access without notice if usage patterns suggest abuse, excessive load, or policy violations; and
- Commercial resale of API access is prohibited without a written reseller agreement.
9. Reporting Violations
If you become aware of a potential violation of this AUP — whether by another user, a third party, or the Service itself — please report it promptly to support@lenera.ai.
10. Enforcement
10.1 Consequences of Violation
Violation of this AUP may result in, at Lenera AI's sole discretion:
- Immediate suspension of access to the Service, with or without notice;
- Permanent account termination;
- Removal or disabling of offending content;
- Civil litigation for damages, injunctive relief, or both; and
- Reporting to law enforcement, regulatory bodies, or affected third parties where required or appropriate.
10.2 No Obligation to Monitor
Lenera AI is under no obligation to monitor all content or activity on the Service. Our exercise of discretion to investigate or act on a violation in one instance does not create an obligation to do so in any other instance.
10.3 Cooperation with Law Enforcement
Lenera AI will cooperate with law enforcement authorities in connection with investigations of violations of this AUP or applicable law, including disclosing account information as required by valid legal process.
11. Amendments
Lenera AI may update this AUP at any time. For material changes, we will provide at least thirty (30) days' prior notice via email or in-platform notification. Continued use of the Service after the effective date of a revised AUP constitutes acceptance of the updated terms. If you do not agree to an updated AUP, you may terminate your subscription in accordance with the applicable MSA or ToS.
